Saginaw Charter Amendments and Sales Tax Reauthorization

The City Charter is the city’s most important legal document – similar to a constitution for a state or a nation. The City Charter defines the organization, powers, functions, and essential procedures of the city government.

The Special Election will ask voters to accept or reject the recommended changes contained in Propositions A-Q (Proposition R is not related to the City Charter).

PROPOSITION A

Ballot PropositionShall the Saginaw Home Rule Charter be amended to clarify procedures for boundary adjustments by revising Section 2.01?

Ballot PropositionShall the Saginaw Home Rule Charter be amended to allow the council to establish additional regular meetings by revising Section 5.10; to transfer responsibilities over city departments to the city manager by deleting Section 6.03(2) and Section 7.01 and adding Section 6.05(10); to provide for a quorum and procedures for filling vacancies in the event there are more than three vacancies on the council by adding Section 5.11; to change “inquiry” to “conduct investigations” in Section 6.03(5); and to provide that the city council shall appoint the city secretary by amending Section 6.06, and to provide that the mayor pro-tem shall be appointed by the city council by revising Section 6.02 ?

If I Vote FORThese language changes would clarify how city council meetings are scheduled and add language defining how many members constitute a quorum in the event of multiple vacancies.
It also transfers responsibility over city departments from the city council to the city manager. The city council would still set policy, and the city manager would oversee day-to-day operations.
The city council as a whole would be able to conduct investigations involving municipal affairs (but not individual council members) as opposed to being limited to making inquiries.
The city secretary would be appointed by the city council, not just the mayor.
And the mayor would be included with the rest of the council in the appointment of the mayor pro-tem.
If I Vote AGAINSTIf there were multiple vacancies on the city council, there would be no rules about how many of the remaining council members would need to be present to conduct city business. The oversight of employees and city operations would remain with the city council. The council’s authority to investigate issues and problems involving municipal affairs would be restricted to asking questions. The city secretary would be appointed by the mayor, but the mayor would not be involved in the appointment of the mayor pro-tem.

Passage of this proposition would change the requirements for the Judge of the Municipal Court from “competent” to “a licensed attorney in the State of Texas with at least five (5) years of experience”. It also clarifies how the judge will be appointed (by ordinance approved by a majority of the council), and allows the judge to request a public hearing before being removed by a council vote.
If I Vote AGAINSTThe qualifications for Judge of the Municipal Court would not conform to the requirements of state law and would need to be addressed by a future proposition.

What is a sales and use tax?

This is the formal name for a sales tax. Individuals pay sales taxes on most goods and services in Texas.

What is the current sales tax rate?

The base rate for the Texas sales tax is 6.25%. However, local government agencies (cities, counties, special purpose districts and transit authorities) can hold elections to increase the sales tax in their area. By law, the maximum sales tax rate (including state and local sales taxes) is 8.25%.

Ballot PropositionThe reauthorization of the local sales and use tax in the City of Saginaw at the rate of one-eighth of one percent to continue providing revenue for maintenance and repair of municipal streets. The tax expires on the fourth anniversary of the date of this election unless the imposition of the tax is reauthorized.

Volver a autorizar el impuesto local a las ventas y al usa en la Ciudad de Saginaw a una tasa de un octavo del uno por ciento para continuar generando ingresos para el mantenimiento y la reparación de calles municipales.
